The Rio judge determined, at the request of the State Prosecutor’s Office, that the Municipality of Nova Iguaçu redo the management contracts or take over the administration of the Hospital da Posse, the Maternidade Mariana Bulhões and three other units of emergency care (UPA) in the city.

O RJ1 showed that the town hall signed the management contracts for these health facilities with two social organizations in an emergency, without a call for tenders. Added together, the contracts reach 217 million reais.

The time has already started counting. The town hall of Nova Iguaçu has 120 days to hire a new management or take over the administration of the health units.

Justice granted the request of the MPRJ which filed a public civil action for suspicion of irregularities.

The decision is signed by Judge Gustavo Quintanilha Telles de Menezes, of the 7th Civil Court of Nova Iguaçu, and declares that the Tender exemption requires verification of concrete risk and imminent harm to the public interest.

O RJ1 showed, last month, when the first publications came out in the Official Gazette, with the signature of the Municipal Secretary of Health, Luiz Carlos Nobre Cavalcanti.

The Institute of Social Organization for Development, Education and Health Care (Ideas) accepted two contracts. One at the General Hospital of Nova Iguaçu, Hospital da Posse, R$137 million. And the other, also urgently, at the municipal maternity Mariana Bulhões, from almost R$47 million.

The Institute of Medicine and Project (IMP) has signed a contract that brings together three municipal emergency care units: the UPA of Austin, the UPA Gisele Palhares Gouvea and the UPA of Comendador Soares. The value exceeds R$ 32 million.

After the change in management, Dr. Joé Sestello, who was general manager of Hospital da Posse for more than a decade, asked to step down. And other personnel from the direction of the General Hospital of Nova Iguaçu also left the unit.

The MPRJ also denounced that the inability of the municipality to regularize the staff is historic. And that before hiring the OSes, he was preparing to issue a public tender for vacant positions in the hospital and maternity ward.

The decision of the 7th Civil Court determines that the social organizations maintain care at Hospital da Posse, in the maternity ward and in the UPAs, until the town hall decides to hire a new management or take over the administration of these units.

And operating systems will continue to be paid for it. Justice agreed with the MPRJ that the hiring was brutal and without reason justifying the haste and the renunciation of the bidding process.

The court ruling indicates that the situation is a typical example of a manufactured emergency, which is not real, concrete, but due to inertia, lack of adequate planning by the manager and, in some cases, bad faith.

OS Ideas, which took over the most expensive contracts at Hospital da Posse and the Municipal Maternity Hospital, is headquartered in Florianópolis (SC) and operates at least twelve health units across the country – seven in RJ.

The Institute of Medicine and Project operates five units at RJ.
