The risks associated with the use of artificial intelligence (AI) raise significant concerns that deserve attention. Although specific answers may vary, we can consider some warning scenarios.

One of the main risks is the issue of confidentiality. The use of AI involves sharing a large amount of data, including sensitive information. This may compromise the principle of confidentiality, contradicting regulations such as the General Data Protection Act (GDPR).

To illustrate this risk, consider the example of a professional working on a confidential project for a company that decides to use AI to capture information on a prototype. Or even a framework dealing with information that cannot be shared publicly, but can be easily entered by the professional into an AI tool. What level of confidentiality do these platforms provide?

Another concern raised by critics of AI is the ease of creating fake profiles and spreading fake news. In an increasingly polarized world with few effective mechanisms to combat the spread of fake news, caution is warranted, in addition to relying on fact-checking consortia. Also, given the speed at which these tools generate content, how effectively will we be able to combat inaccurate or misleading information?

Intellectual property also presents an area of ​​risk, especially since AI has been used to recreate the voices of global entertainment artists. Some artists, like Grimes, have shown support for royalty sharing of AI-generated music. However, others, like Canadian rapper Drake, have encountered issues with songs attributed to them but generated by the AI. Platforms like Spotify, which share AI-generated music, are tightening controls and removing those songs from the platform. In this context, intellectual property lawyers must be prepared for the challenges that may arise.

A less discussed but fundamental aspect is the possibility of creating malicious codes via AI. Additionally, AI can be used to produce phishing messages aimed at stealing data, which requires adequate cybersecurity measures to mitigate the risk.

Advances in AI are impressive, but each innovation still needs to be carefully studied, debated and closely monitored by all stakeholders. In this brave new world, we cannot ignore the risks that permeate every decision and every action.

Despite the warnings and concerns raised about the use of AI, it is essential to recognize that this technology also offers many benefits and opportunities. Discussions around AI will continue to dominate conversations among professionals, in positive, negative and constructive aspects. While understanding and managing the associated risks is crucial, we must maintain a cautiously positive view of the transformative potential of this tool.
